The Executive Yuan has revised its "Regulations Regarding the Entry and Exit of Foreigners Residing or Staying in the R.O.C.," stipulating that foreigners will be denied an exit permit if a governmental agency has restricted their exiting the country or if a matter involving them is pending before the law.
The revised regulations, promulgated and implemented by the Ministry of the Interior, include the following points:
* Regarding foreign residents--persons who have lost their R.O.C. citizenship and who have not obtained the citizenship of a foreign country as well as the children of a Chinese mother and a foreign father who do not have R.O.C. citizenship and who have not yet received citizenship of a foreign country shall apply for a residency permit as a person without nationality.
* Regarding foreign visitors--foreign service personnel accompanying an aircraft or a vessel who must remain in the R.O.C. temporarily because of repairs and foreign tourists who must remain in the country because of illness or other unforeseen circumstance must apply for a seven-day temporary residency permit.
* Foreigners may be expelled from the country by the Ministry of the Interior for the following reasons:
1. Revocation of visa.
2. Overstay of visit.
3. Participation in activities inconsistent with visa.
4. Judgment of expulsion from country.
5. Inability to support oneself within the country.
6. Suspicion of having harmed the public order or morals.
7. Slandering the head of state in writing, pictures, or speech or maliciously defaming the government or officials of the R.O.C.
8. Commission of a crime outside the R.O.C. for which a warrant is pending or conviction of a felony for which time has not been served.
9. Suspicion of behavior in violation of R.O.C. law.
Foreigners subject to an expulsion order must leave the country within seven days after notification. Those who fail to do so will be forced to leave.
Foreigners must report for temporary asylum via their local police station to the National Police Administration in the Ministry of the Interior under the following circumstances:
1. Failure to perform proper exit procedures after receiving an expulsion order.
2. Illegal entry or overstay of visit.
3. Inability to support oneself due to an unconcluded case at law.
4. Other circumstances under which protection is believed to be required.
